TERMS AND CONDITIONS:

Release of Liability

• As parent/guardian of my “Child/Children” who will be participating in private swim lessons provided by 101iswim, an extension program of Boot Camp H2O, LLC, I agree and understand that swimming can be a HAZARDOUS activity.

• I hereby agree as follows: I assume full responsibility for, and total risk of, any injury, loss, or damages (including injury to person or loss of property) sustained by me and/or my Child(ren) at the location where the lesson takes place. I further release Igor Porciuncula, Boot Camp H2O, LLC, and the owners of the home where lessons are being held, as well as their affiliates and their directors, officers, employees, staff members, instructors, agents, independent contractors, and representatives (the “Releasees”) from any claim whatsoever resulting from my Child(ren)’s participation in swim lessons or on account of first aid treatment, emergency medical services or other services rendered to me or my Child(ren) during my Child(ren)’s participation in swim lessons at the location where the lesson takes place.

• I hereby release, waive, and forever discharge Releasees from all liability to me, my Child(ren), my spouse (if any), our respective legal representatives, heirs and assigns and any person claiming through or under myself or my Child(ren) of and from any and all present and future claims, demands, damages, actions or rights of action, whether legal or in equity, arising from or by reason of any bodily injury or personal injuries known or unknown that may occur as a result of my Child(ren)’s participation in swim lessons or programs at the location where the lesson takes place, except to the extent that such injury or damage is caused by the gross negligence or willful or wanton act or omission of Releasees.

• I understand and accept these responsibilities.

Cancelation Policy

• ​PAYMENTS ARE DUE ON A MONTHLY BASIS EVERY FIRST WEEK OF THE MONTH.

• Clients will accumulate credits based on the date notice is given for a cancelation during swim season - MAY to SEPTEMBER, according to the credit system below;

• Credits cannot be used to pay for your regular weekly lessons and will not be refunded or transferred;

• Credits can be used to book classes during OCTOBER 2023;

• Upon availability and instructor discretion, credits may also be used to book LAST-MINUTE SESSIONS (48hrs or less) Monday through Friday outside prime time hours (02:00 pm to 06:30 pm) / Sunday outside prime time hours (09:00 am to 01:00 pm) for the months of May to September 2022;

• Credits expire after October 2023.

• Cancelations must be made by text message.

CANCELATION POLICY CREDIT SYSTEM:

Cancel less than 48hrs notice - NO CREDIT

Cancel between 48 hours to 7 days - RECEIVE 50% credit

Cancel between 8 days to 15 days - RECEIVE 75% credit

Cancel between 16 days to 1 month - RECEIVE 100% credit

Cancel with more than one month's notice - NO PAYMENT IS REQUIRED FOR THAT DATE

*** Credits accumulated from cancelations made by the instructor are 100% and can be applied towards your next monthly payment.

• It is the responsibility of the host house to make sure the pool is clean and well-maintained.  Please check on a regular basis for possible maintenance issues, especially heater problems.  Also, please coordinate your swim lesson schedule with your Gardener and Pool Guy.   

• If you cancel and the host still moves forward with the lesson: you must provide a pool for a future date to schedule your extra class and redeem your credits.;

• If the host cancels: you can talk to the host and move forward with the lesson at their house, you can arrange to swim at someone else's pool for that week (being conscious of logistics, of course), or you can cancel as well and get 50% or more back in the form of cancellation credit.

Parent or Guardian Permission:  As the parent or guardian, I give my permission for my son/daughter to participate in private swim lessons, and I have read carefully and understood the POLICIES and RELEASE OF LIABILITY written above and sign it with full knowledge of its content and significance, and I am keeping a copy of this statement, which is valid for the time of my child(s) participation in this program.
